Notice of Public Meeting regarding Zoning By-law Amendment 04/24
TAKE NOTICE that Township Council will hold a public meeting to consider a proposal to amend the comprehensive Zoning By-law under Section 34 of the Planning Act, R.S.O. 1990, as amended.
The Public Meeting to discuss this application will be held on June 25, 2024, at 5:45 pm
NOTE: At the time of posting of this notice the Township is anticipating that this meeting will be held in person at Township Council Chambers (4805 William Hastings Line) in Crosshill. Arrangements for electronic participation in this meeting will also be made available on the Township website at least 48 hours prior to the public meeting. This meeting is required by the Planning Act, R.S.O. 1990, as amended. At this meeting, members of Township Council will listen to any comments or presentations in favour of and/or in opposition to the application. A DECISION MAY OR MAY NOT BE MADE AT THIS MEETING.
DETAILS OF THE APPLICATION:
The owner of these lands has applied to amend the Township Zoning By-law to allow a garden suite as a temporary use on the subject lands. The property is currently zoned Agricultural (A1).
The subject lands are 24.57 hectares in area, and contain a house, farm buildings, and shop (under development). The “A1” Zone permits a primary detached dwelling on a lot. The garden suite will be in the form of a temporary structure. The garden suite is proposed to be located north of the existing house. The garden suite will be approximately 140.47 m2 (1512 ft2) in area. The lands would remain zoned A1 but would subject to a site-specific provision to add the temporary use of the garden suite. The temporary use would be permitted for up to 20 years.
The size of the proposed garden suite is larger than what is permitted in the Zoning By-law (Section 4.14). The maximum floor area permitted for a garden suite is 93 m2, whereas the applicant is seeking an increase to 140.47 m2. Therefore, the owner is requesting additional relief as part of this application.
No changes are proposed to the existing access to the property from Broadway Street (Township Road at this location). The property contains GRCA regulated floodplain area however the proposed garden suite is not within this area.
Any persons may attend the public meeting and make written and/or verbal representation either in support of or in opposition to the proposed amendment.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Wellesley before the by-law is passed, the person or public body is not entitled to appeal the decision of the Council to the Ontario Land Tribunal.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township of Wellesley before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
